Employer & Company Terms

Terms for businesses posting jobs, hiring talent, and using enterprise recruitment features.

1. Employer Account

1.1 Account Registration

By registering as an employer or company on REWORK., you represent and warrant that you have the authority to bind the organization you represent. You are responsible for all activity under your company account, including activity by authorized team members.

1.2 Company Profile

All company information, including business name, description, industry, and job postings, must be accurate, truthful, and not misleading. REWORK. reserves the right to verify company information and remove or restrict profiles that contain false or misleading information.

1.3 Account Ownership

As between employer users and the organization, the employer account belongs to the organization. However, if an individual user has a personal account separate from an employer account, the personal account remains the property of the individual.

2. Job Posting Responsibilities

2.1 Lawful Postings

Employers are solely responsible for ensuring that all job postings, recruitment communications, and hiring practices comply with applicable laws in every jurisdiction where the position is offered, including but not limited to:

  • Anti-discrimination and equal opportunity employment laws
  • Minimum wage and labor standards
  • Work eligibility and immigration requirements
  • Privacy and data protection regulations
  • Occupational health and safety requirements
  • Contractor classification and employment status laws

2.2 Prohibited Postings

Employers may not post jobs that:

  • Discriminate based on race, gender, age, religion, disability, sexual orientation, or other protected characteristics
  • Require applicants to pay fees or purchase products as a condition of employment
  • Are misleading regarding compensation, job duties, or employment terms
  • Request sensitive personal information (Social Security numbers, bank details, government IDs) through the platform
  • Violate any applicable law or regulation
  • Are fraudulent, deceptive, or relate to illegal activities

2.3 Hiring Decisions

All hiring and recruitment decisions are made solely by the employer. REWORK. does not participate in, influence, or take responsibility for any hiring decision. Employers must use their own independent judgment and may not rely on or delegate decision-making authority to the Platform.

3. Talent Access & Usage

3.1 Candidate Search & AI-Powered Filtering

REWORK. provides employers with candidate search capabilities enhanced by AI-powered filtering. These tools allow employers to surface relevant candidates based on skills, experience, verified credentials, and Proof of Work data. Employers acknowledge that AI-powered search results are algorithmic recommendations and do not constitute endorsements of any candidate's suitability for a particular role.

3.2 Candidate Information

Employers may access candidate profiles, verified credentials, and Proof of Work data solely for the purpose of evaluating candidates for legitimate employment or contract opportunities. Employers may NOT:

  • Use candidate data for purposes other than legitimate recruitment
  • Sell, share, or distribute candidate information to third parties without authorization
  • Use data for discriminatory screening or profiling
  • Contact candidates for unsolicited marketing or sales purposes
  • Harvest, scrape, or bulk download candidate data

3.3 Confidentiality Obligations

Employers must maintain the confidentiality of all candidate information accessed through the Platform and handle such information in compliance with applicable privacy and data protection laws, including PIPEDA, GDPR, and CCPA as applicable.

4. Subscription Plans

4.1 Company Service Fee Tiers

REWORK. uses a commission-first model for companies. Service fee tiers auto-unlock based on your hiring history — no mandatory monthly subscription required:

  • Starter (5% fee) — Default tier. Includes basic project posting, expert search, and milestone-based escrow. Suitable for companies starting with automation hiring.
  • Growth (3.5% fee) — Unlocks at 3+ projects hired, $5K+ spent. Includes priority expert matching, multi-milestone escrow, e-signature contracts, and basic team management.
  • Scale (2.5% fee) — Unlocks at 10+ projects hired, $25K+ spent. Includes AI-matched expert shortlists, multi-currency escrow, 35+ country compliance, and ROI analytics.
  • Enterprise (1.5% fee) — Unlocks at 30+ projects hired, $100K+ spent. Includes unlimited posts, dedicated talent matching, volume billing, custom legal templates, and priority support.

An optional Business Hub subscription ($99/mo) provides additional premium tools including unlimited project posts, unlimited profile views, 35+ country compliance with e-signatures, 10 team seats, multi-currency escrow dashboard, SSO (SAML/OIDC), and dedicated support.

4.2 Billing & Renewal

Subscription fees are billed in advance on a monthly or annual basis as selected at the time of purchase. Subscriptions automatically renew at the end of each billing period unless cancelled prior to the renewal date. REWORK. reserves the right to modify subscription pricing with at least thirty (30) days' prior written notice. Continued use of the Platform following a price change constitutes acceptance of the updated pricing.

4.3 Downgrade & Cancellation

Employers may downgrade or cancel their subscription at any time through their account settings. Downgrades take effect at the start of the next billing period. No refunds are provided for partial billing periods. Upon cancellation, access to tier-specific features will terminate at the end of the current billing cycle, and employer data will be retained in accordance with our data retention policies.

5. SwitchAsses Hiring Intelligence

5.1 Scope of AI Hiring Tools

Employers with access to SwitchAsses hiring intelligence may utilize the following features as informational aids in their recruitment process:

  • Confidence Scores — Algorithmic assessments indicating the estimated likelihood of a successful hire based on available candidate data and role requirements.
  • Role-Fit Analysis — AI-generated evaluations comparing candidate qualifications, skills, and experience against the stated requirements and preferences of a posted role.
  • Regret Minimizer Reports — Predictive analyses designed to surface potential risks or misalignments in a prospective hire, based on historical patterns and available data points.
  • Bias Detection — Automated auditing tools that analyze hiring patterns and job posting language to flag potential sources of bias in the recruitment pipeline.

5.2 Limitations & Disclaimer

SwitchAsses hiring intelligence tools are provided as decision-support aids only and do not constitute employment advice, legal counsel, or binding recommendations. Assessment results and AI-generated insights may contain errors, inaccuracies, or reflect incomplete information. Employers must not rely solely on automated tools for hiring decisions and must exercise independent human judgment in all final hiring determinations.

5.3 Compliance Automation

REWORK. provides compliance automation tools including contractor classification guidance, tax document generation, and remote work policy templates. These tools are provided for informational convenience only and do not constitute legal, tax, or regulatory advice. Employers are solely responsible for ensuring that their use of compliance automation tools produces outputs that are accurate and compliant with the laws of all applicable jurisdictions.

6. Hiring Analytics & Observatory

6.1 Hiring Analytics Dashboards

REWORK. provides hiring analytics dashboards that aggregate data on job posting performance, candidate pipeline metrics, time-to-hire statistics, and recruitment funnel analytics. The data presented in analytics dashboards is derived from Platform activity and is provided on an "as-is" basis. REWORK. does not guarantee the completeness or accuracy of analytics data and assumes no liability for decisions made in reliance on such data.

6.2 Observatory Dashboard

The Observatory dashboard provides employers with access to aggregated, anonymized labor market insights including hiring trends, compensation benchmarks, talent supply and demand indicators, and industry-level workforce analytics. All Observatory data is derived from aggregated Platform activity and publicly available sources. Observatory insights are provided for general informational purposes only and do not constitute market research, financial advice, or guarantees of labor market conditions. Employers may not redistribute, republish, or commercially exploit Observatory data without prior written consent from REWORK.

7. Data Obligations for AI Hiring Tools

7.1 Responsible Use of AI in Hiring

Employers using AI-powered hiring tools on the Platform acknowledge and accept the following obligations:

  • Employers must conduct their own assessment of whether use of AI hiring tools complies with all applicable laws in their jurisdiction, including but not limited to anti-discrimination statutes, automated employment decision tool (AEDT) regulations, and local bias audit requirements.
  • Where required by law, employers are responsible for providing candidates with notice that AI tools are being used in the hiring process and for obtaining any required consent.
  • Employers must not use AI-generated outputs (including confidence scores, role-fit analyses, and regret minimizer reports) as the sole or determinative basis for adverse employment decisions without independent human review.
  • Employers are responsible for conducting or procuring any bias audits required by applicable law with respect to their use of automated hiring tools on the Platform.

7.2 EU AI Act Considerations

Employers operating within the European Union or targeting EU-based candidates acknowledge that AI systems used in recruitment and employment contexts may be classified as "high-risk" under the EU Artificial Intelligence Act (Regulation (EU) 2024/1689). Employers using REWORK.'s AI hiring tools in connection with EU-based candidates are responsible for:

  • Ensuring appropriate human oversight of AI-assisted hiring decisions as required by the EU AI Act
  • Maintaining transparency with candidates regarding the use of AI in recruitment processes
  • Conducting fundamental rights impact assessments where required by applicable regulation
  • Retaining documentation and logs of AI-assisted hiring decisions as mandated by law

7.3 Data Retention & Deletion

Employers must comply with all applicable data retention and deletion obligations with respect to candidate data obtained through the Platform. Where AI hiring tools generate derivative data (such as scores, assessments, or reports) based on candidate information, employers are responsible for ensuring that such derivative data is retained and deleted in accordance with applicable privacy laws. REWORK. may retain anonymized, aggregated data derived from employer use of AI hiring tools for purposes of platform improvement and bias monitoring.

8. Employer Indemnification

Employers agree to indemnify, defend, and hold harmless REWORK. from any claims, damages, losses, or expenses arising from:

  • Unlawful job postings or discriminatory hiring practices
  • Misuse of candidate data or privacy violations
  • Misclassification of workers (employee vs. contractor)
  • Employment disputes with workers hired through the Platform
  • Breach of applicable employment, labor, or data protection laws
  • Any claims by candidates or third parties related to the employer's use of the Platform
  • Non-compliance with AI hiring regulations, including bias audit requirements and the EU AI Act
  • Misuse or over-reliance on AI-generated hiring intelligence outputs

9. No Employment Relationship

Use of the Platform does not create any employment, joint employment, agency, partnership, or franchise relationship between REWORK. and any employer, candidate, or agent. REWORK. is a technology platform provider only and bears no responsibility for any employment relationship that may arise between users of the Platform.
