THE PLATFORM AND ALL SERVICES, CONTENT, FEATURES, AI TOOLS, AND MATERIALS ARE PROVIDED STRICTLY "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose, non-infringement, or title
Warranties that the Platform will be uninterrupted, timely, secure, error-free, or virus-free
Warranties regarding the accuracy, reliability, completeness, or currentness of content
Warranties regarding results, outcomes, performance, or return on investment
Warranties regarding seller or service provider qualifications, competence, services, or results
Warranties regarding third-party platform approvals, employment, or opportunities
Warranties regarding AI-generated content accuracy, reliability, or suitability
Warranties regarding the quality or legality of job postings, projects, or opportunities
Warranties regarding the identity, qualifications, or intentions of other users
Warranties regarding data accuracy, completeness, or timeliness from third-party sources

WE EXPRESSLY DISCLAIM ALL WARRANTIES to the maximum extent permitted by applicable law. You use the Platform entirely at your own risk.

Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the above exclusions shall apply to the maximum extent permitted by law.

2. AI Features & Automated Tools Disclaimer

The Platform provides AI-powered features and automated tools, including but not limited to AI Copilot, SwitchAsses, and the AI Resume Builder. With respect to these features, you acknowledge and agree that:

AI Copilot: AI Copilot outputs, including recommendations, suggestions, guidance, and generated content, are provided for informational and assistive purposes only. They do not constitute professional advice and should not be relied upon as the sole basis for career, financial, or employment decisions
SwitchAsses: SwitchAsses assessment results, skill evaluations, readiness scores, and competency analyses are algorithmically generated approximations. They do not guarantee actual job performance, employer acceptance, or platform approval and may not reflect your true abilities in all contexts
AI Resume Builder: Resumes, cover letters, and application materials generated or enhanced by AI tools may contain inaccuracies, formatting issues, or content that does not fully represent your qualifications. You are solely responsible for reviewing, verifying, and approving all AI-generated application materials before submission
Loevech: Loevech assessment results, ratings, and evaluations are generated through automated processes and algorithmic analysis. These results are indicative estimates and do not constitute definitive measures of skill, competency, or professional value

REWORK. makes no warranties regarding the accuracy, completeness, reliability, or suitability of any AI-generated output. All AI features are subject to the inherent limitations of machine learning technology, including potential biases, errors, and hallucinations. You should independently verify all AI-generated content before relying on it.

3. Proof of Work & Verification Disclaimer

The Platform offers Proof of Work verification services to validate user credentials, work history, and professional accomplishments. With respect to these verification services, you acknowledge and agree that:

Proof of Work verification results are based on the information and documentation provided by users and third-party sources, which may be incomplete, outdated, or inaccurate
REWORK. does not guarantee the absolute accuracy, completeness, or reliability of any verification outcome
Verification status may change over time as new information becomes available or as verification methodologies are updated
Employers, clients, and other parties relying on Proof of Work verification results do so at their own risk and should conduct their own independent due diligence
A Proof of Work verification does not constitute an endorsement, recommendation, or guarantee of any user's qualifications, skills, or suitability for any particular role or engagement

4. No Guarantees

WE MAKE ABSOLUTELY NO GUARANTEES, PROMISES, OR WARRANTIES REGARDING:

Employment, job placement, contract work, or approval on any platform
Income, earnings, financial results, or return on investment of any kind
Success rates, approval rates, or performance metrics of any kind
Quality, accuracy, or effectiveness of services provided by sellers or service providers
Availability, continuation, or terms of opportunities on third-party platforms
Acceptance, approval, or continued engagement with any employer or client
The accuracy of AI-generated insights, recommendations, or assessments
The accuracy or reliability of SwitchAsses scores, Loevech results, or Proof of Work verifications
Platform availability, uptime, or uninterrupted service
Security of data transmitted through or stored on the Platform

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REWORK DIGITAL, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, PARTNERS, CONTRACTORS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

Direct, indirect, incidental, special, consequential, exemplary, or punitive damages
Loss of profits, revenue, data, use, goodwill, business opportunities, or other intangible losses
Damages arising from your use or inability to use the Platform or any service
Damages arising from unauthorized access to or alteration of your account or data
Damages arising from errors, bugs, viruses, security breaches, or system failures
Damages arising from actions, omissions, or conduct of sellers, service providers, employers, or other users
Damages arising from employment decisions, rejections, terminations, or missed opportunities
Damages arising from service quality, results, outcomes, or lack thereof
Damages arising from payment disputes, refund denials, or transaction failures
Damages arising from content accuracy, reliability, or reliance on Platform information
Damages arising from third-party services, integrations, or linked content
Damages arising from AI-generated content, recommendations, or automated decisions, including outputs from AI Copilot, SwitchAsses, the AI Resume Builder, or Loevech
Damages arising from Proof of Work verification results, inaccuracies, or reliance on verification status
Damages arising from changes to or discontinuation of any Platform feature

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100 USD) OR (B) THE TOTAL AMOUNT YOU PAID DIRECTLY TO REWORK DIGITAL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

These limitations apply regardless of whether the alleged liability is based on contract, tort (including negligence), strict liability, statutory liability, or any other legal theory, and even if REWORK. has been advised of the possibility of such damages.

6. Indemnification

You agree to indemnify, defend, and hold harmless REWORK., its officers, directors, employees, agents, affiliates, partners, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees and court costs) arising from or related to:

Your use or misuse of the Platform or any service
Your violation of these Terms or any referenced policy
Your violation of any applicable law, regulation, or third-party rights
Your content, submissions, or communications on the Platform
Your interactions with sellers, service providers, employers, or other users
Your employment applications, hiring decisions, approvals, rejections, or terminations
Your payment disputes, chargebacks, or refund claims
Any fraudulent, deceptive, negligent, or illegal activity
Your breach of any representation or warranty made under these Terms
Any claim by a third party arising from your actions on or through the Platform
Any fraudulent, deceptive, or misleading conduct in connection with services you provide through the Platform
Refunds, chargebacks, or reversals resulting from your failure to deliver services as described

This indemnification obligation survives termination of your account and these Terms and is in addition to (not in lieu of) any other remedies available to REWORK..

7. Force Majeure

REWORK. shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, government actions, cyberattacks, power outages, internet service failures, or third-party service disruptions.

8. Assumption of Risk

BY USING THE PLATFORM, YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND ACCEPT THE INHERENT RISKS ASSOCIATED WITH ONLINE PLATFORMS, CAREER SERVICES, AND EMPLOYMENT MARKETS. You voluntarily assume all risks arising from your use of the Platform, including the risk of financial loss, unsatisfactory results, unsuccessful applications, and interactions with other users.
